The “ Vita Nova” Fertility Clinic is one of the largest fertility centers not only in
Georgia but also in the Post Soviet Countries. The clinic was established as an IVF
department in 2007 and since that time has maintained its reputation as being one

surrogacy is legal. Particularly, the law that regulates this third-party assisted
reproduction treatment came into force in 1997.

the country. The Greater Caucasus Mountains influence the climate of Georgia by
keeping cold northern winds away. The Lesser Caucasus Mountains partially protect
the country form dry and hot air masses from the South. Winters are short and
rather mild. Spring and Autumn are the wettest seasons, Winter and Summer –
the driest. The average temperature in summer is between 20-24 degrees Celsius, in
winter 2-4. Humidity is lower.

Surrogacy In Georgia
For couples having problems with conceiving children and looking for modern
infertility treatments at reasonable costs, Georgia is a great option. However,
because of its proximity to and easy accessibility from other European and Middle
Eastern countries, Georgia is an easy-to-travel medical tourism destination. Georgia
is a potential destination for intended parents who are considering having a baby via
surrogacy abroad, as surrogacy is legal since 1997.
To date, intended parents who pursue surrogacy in Georgia usually come from a
Israel, Sweden, United States, United Kingdom, China, Germany, Austria, Poland,
Spain, Switzerland, Malaysia, Egypt, Canada, Italy, Belgium, Iran, Ireland, Russia,
Greece and Turkey for reasons related to too strict regulations and/or elevated costs
also, one of the main reasons can be that in Georgia there is no waiting list, once you
signed the contract, you will start procedure same day.
As one of the few countries that allows for international surrogacy, Georgia is an
ideal location for coupes throughout the world to pursue their dreams of parenthood.
Georgian legislation does not allow gestational surrogate mothers to keep the baby
following delivery and only the names of the commissioning parents are written on
the baby ’ s birth certificate. This allows the parents-to-be to obtain the birth
certificate in their name in just a day and offers peace of mind for many couples.
Surrogate mothers are also required to comply with all medical laws, maintain
excellent health and have at least one child prior to participating in a surrogacy
The Georgian law gives the right to have a baby through surrogacy. As our medical
and governmental law is maximally customized and very flexible for foreigners , the
laws support surrogacy and donation and the rights of as parents as children also. In
our country according to our law the surrogate has no right to the child, all rights are
supporting the biological parents.
Georgia Legislation Related to IVF Procedures
According to the Georgian law in case of the child born by a surrogate mother the
couple and not the surrogate mother will be registered as the parents of the child.
Even in case an embryo obtained from an egg or spermatozoon which was obtained
not from the infertile couple but from a donor is transferred into the uterus of the
surrogate mother, the couple will be deemed as the legal parents of the child.
The birth certificate will be issued immediately after the child birth, within 1 day. The
couple will be registered as the parents in the birth certificate Thus a birth certificate
of the child born by a surrogate mother does not differ from the birth certificate of
any other children. Consent of the surrogate mother is not required for registration
of the infertile couple as parents.
The following will be required for registration of the couple as parents:
Surrogacy Agreement made by the couple, certificate of embryo transfer into the
uterus of the surrogate mother issued by the IVF clinic and certificate of the fact of
childbirth issued by maternity hospital.

Public Registry of Georgia (Surrogacy Birth Registration)
Extracorporeal fertilization (IVF) is allowed:
For the purpose of treatment of infertility, as well as in case of risk of transmission of
genetic disease on a wife’s or a husband’s part, by using sex cells or an embryo of
the couple or a donor, if the couple’s written consent has been obtained. For the
purpose of transfer and growth of the embryo obtained as a result of fertilization to
the uterus of another woman (“surrogate mother”). The couple’s written consent
is obligatory. The couple is considered to be parents in case of the childbirth with the
responsibility and authority ensuing from it. A donor or a “surrogate mother” has
no right to be recognized as a parent of the born child.
For the purpose of artificial fertilization it is possible to use female and male sex cells
or an embryo conserved by the method of freezing. The time of conservation is
determined according to the couple’s will by established procedure.
Egg and sperm donation are also allowed, in case the couple needed any of these
options. In fact, the identity of donors can be disclosed to the intended parents. As
long as they agree, they can even get to know her in person.
As mentioned above, once the child is born, the IPs will be deemed as parents,
having all the legal responsibilities and rights derived from it. The surrogate shall not
have any rights to the child, and by no means will be recognized as the legal mother
of the child.
The following are other aspects to keep in mind:
• The birth certificate is issued within 24 hours from childbirth.
• The names of the IPs will be put on the child’s birth certificate following birth.
• The IPs do not need consent from the surrogate to be registered as the child’s
These are major advantages in comparison with other surrogacy destinations, as in
most of them it is necessary for the surrogate to relinquish her parental rights in
order for the commissioning parents to be considered the legal parents of the child.
Although further formalities will be required by their home country, this definitely
speeds up the process.
